This Copyright Policy is incorporated by reference into our Terms & Conditions and governs all content submitted to BigOX for printing and fulfillment services. By using our services, you agree to comply with this policy and all applicable copyright laws.

Customer Rights & Responsibilities

Content Ownership Requirements

You must own the copyright to all submitted content OR have obtained proper written authorization from the copyright holder. By submitting any image, artwork, photograph, or other creative content to BigOX, you affirm that:

• You are the original creator and copyright owner of the submitted content, OR
• You have obtained explicit written permission from the copyright holder to reproduce the work for commercial printing purposes, OR
• The content is in the public domain or falls under applicable fair use provisions

You are solely responsible for ensuring you have the legal right to reproduce and distribute all submitted content.

Prohibited Content

The following types of content are strictly prohibited and will result in immediate order cancellation and potential account termination:

• Copyrighted material used without proper authorization or licensing
• Trademarked logos, brands, or designs used without permission
• Content that violates an individual's right of publicity or privacy
• Photographs of recognizable individuals without proper model releases
• Images of private property or buildings without property releases
• Content that violates any applicable laws or regulations
• Obscene, defamatory, or otherwise illegal material

Required Rights & Releases

For certain types of content, you must obtain and maintain documentation of:

• Model Releases: Written consent from any recognizable individuals appearing in photographs
• Property Releases: Permission to photograph and reproduce images of private property, buildings, or distinctive locations
• Commercial Licenses: Appropriate licensing for any third-party elements included in your designs
• Trademark Permissions: Written authorization to use any trademarked logos, brands, or designs

BigOX reserves the right to request proof of these permissions before processing orders.

License Grant to BigOX

Necessary Rights for Fulfillment Services

By submitting content to BigOX, you grant us a limited, non-exclusive, royalty-free license to:

• Reproduce your content for the specific purpose of fulfilling your print orders
• Display your content internally for order processing, quality control, and customer service
• Make necessary technical adjustments (color correction, sizing) to optimize print quality
• Package and ship printed products to your designated recipients

Important: BigOX claims no ownership rights to your submitted content. This license is strictly limited to fulfillment services and does not grant BigOX any rights to use your content for marketing, resale, or any other purposes without your explicit written consent.

License Scope & Duration

This license automatically terminates upon:

• Completion of your specific print order
• Cancellation of your order
• Closure or termination of your account
• Your written request to remove content from our systems

Customer Representations & Warranties

By using BigOX services, you represent and warrant that:

1. Legal Authority: You have the full legal right and authority to submit content and grant the licenses described in this policy
2. No Infringement: Your submitted content does not infringe upon any copyright, trademark, right of publicity, privacy, or other proprietary rights of any third party
3. Accurate Information: All information provided to BigOX is true, complete, and accurate
4. Compliance: You will comply with all applicable laws and regulations regarding your submitted content

Indemnification

You agree to indemnify, defend, and hold harmless BigOX and its officers, directors, employees, contractors, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or relating to:

• Any breach of your representations and warranties in this policy
• Any claim that your submitted content infringes third-party intellectual property rights
• Any violation of applicable laws in connection with your use of BigOX services
• Any dispute regarding model releases, property releases, or other required permissions

BigOX reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate fully in such defense.

DMCA Compliance Procedures

BigOX complies with the Digital Millennium Copyright Act (DMCA) and maintains policies to address copyright infringement claims.

Filing a Copyright Takedown Notice

If you believe your copyrighted work has been reproduced without authorization through BigOX services, you may file a DMCA takedown notice that includes:

Required Information:

• A description of the copyrighted work you claim has been infringed
• Identification of the allegedly infringing material and its location in our system
• Your contact information (name, address, phone number, and email address)
• A statement that you have a good-faith belief that the use is unauthorized
• A statement that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf

BigOX Response to Takedown Notices

Upon receiving a valid DMCA notice, BigOX will:

1. Review the claim within 24-48 hours
2. Remove or disable access to the allegedly infringing material if the claim appears valid
3. Notify the customer who submitted the material about the takedown
4. Document the claim for repeat infringer tracking

Counter-Notification Process

If you believe your content was removed in error, you may submit a counter-notification including:

• A statement under penalty of perjury that the material was removed or disabled as a result of a mistake or misidentification
• Identification of the material and its location before removal
• Your contact information and consent to jurisdiction in the appropriate federal district court
• A statement that you will accept service of process from the person who provided the takedown notice
• Your physical or electronic signature

Counter-notifications should be sent to the same DMCA contact information above.

BigOX will restore the removed content within 10-14 business days unless the original complainant files a court action seeking a restraining order.

Repeat Infringer Policy

BigOX maintains a policy of terminating accounts of users who are repeat copyright infringers:

• First Violation: Warning and content removal
• Second Violation: Temporary account suspension (30 days)
• Third Violation: Permanent account termination

Users may appeal termination decisions by providing evidence that the claims were invalid or made in error.

Special Considerations

AI-Generated Content

For content created using artificial intelligence tools:

• You acknowledge that AI-generated works may have limited or no copyright protection
• You remain responsible for ensuring no third-party copyrighted material was used in training or creating the AI-generated content
• You warrant that your use of AI tools complies with their respective terms of service
